Practical case

Who must be instructed before Monday?

A café with six employees is planning the coming week. On Monday a newly hired server starts. The cook, who has been with the business for four years, will work with a newly purchased combi steamer from Monday. The bookkeeper continues unchanged at the same desk. A temporary helper moves from table service to the espresso machine with its steam wand. Whom must the owner instruct before each of them starts, and may she schedule the instruction in an unpaid hour before the shift?

Hint: Go through the four occasions in section 12(1) sentence 3 and check for each person whether one of them applies. For the second question, read sentence 1.

Show the solution

Section 12(1) sentence 3 ArbSchG requires instruction before the activity starts on recruitment, on changes in the area of responsibility and on the introduction of new work equipment or technology. The server is recruited, the cook receives new work equipment and the helper changes her area of responsibility. No occasion arises for the bookkeeper; repetition is due only where necessary. Under sentence 1 the instruction takes place during working time, so an unpaid hour before the shift is not allowed.

Answer: Server, cook and helper; only in paid working time
