Small-business exemption — does German unfair-dismissal law apply?

General protection against unfair dismissal applies only where MORE than ten employees are normally employed. Part-timers up to 20 hours count 0.5, up to 30 hours 0.75, and trainees do not count. For staff hired before 2004, more than five such long-standing employees is enough.

Calculation assumptions

  • The test is the number of employees „normally“ employed: enter the headcount that is typical of the business, not a snapshot of a given day.
  • Each employee is placed in a band by regular weekly hours: up to 20, over 20 up to 30, over 30. The employee concerned is counted too.
  • Only the threshold of KSchG s. 23 is checked. The six-month qualifying period of KSchG s. 1(1) and the distinction between establishment and company are not examined.
