Calculation assumptions

  • Assumes notice for urgent operational reasons that mentions the severance entitlement, and that the employee lets the deadline for bringing a claim pass; whether the Protection against Dismissal Act applies at all is not checked.
  • Monthly earnings are what the employee receives in cash and in kind, at their regular working hours, in the month the employment ends (KSchG s. 10(3)); enter the gross figure.
  • A payment set by the court (KSchG ss. 9 and 10, up to 12, 15 or 18 months' earnings) or freely negotiated is a different case and is not calculated.
  • Gross result: tax and social security treatment of the payment are not calculated. Rounded to the cent.
