Continued-employment declaration on Germany's integration subsidy (BA EGZ 08)
With the continued-employment declaration (Weiterbeschäftigungserklärung, form BA EGZ 08) you confirm to the employment agency (Agentur für Arbeit) or the Jobcenter that the subsidised person stayed employed with you after the integration subsidy ended — for the whole retention period (Nachbeschäftigungszeit). That period equals the subsidy period, capped at twelve months (§ 92(2) sentence 5 SGB III). If the employment ends earlier, the subsidy must be partly repaid (§ 92(2) sentence 1) unless one of the five grounds in sentence 2 applies; the declaration is then due immediately, with the reasons and a copy of the dismissal or termination agreement. If you applied online, you submit the declaration directly in the case overview and do not need the form.

- As the form states: the length of the retention obligation is in the notice under conditions (Auflagen), the submission deadline under submitting documents (Vorlage von Unterlagen)
- Immediately, if the employment ends earlier
- As the form requires; the repayment duty follows from § 92(2) sentence 1 SGB III, and facts relevant to the refund must be disclosed (§ 60(1) sentence 2 SGB I)

A draft is a file you save wherever you like, just like the document itself: we keep no copy of it and nothing is left in your browser. When signed in, you can also save it to your space to pick it up later — only if you ask.
Official form pre-filled with your data: read every box and check the amounts before filing or paying.
Who this applies to
- Employers who received an integration subsidy, once the retention period following the subsidy period has ended
- Employers whose employment relationship ends WITHIN the retention period — by dismissal, by the employee or by a termination agreement: the declaration must then be sent immediately after the end
- Employers who were subsidised for hiring an especially affected severely disabled person: here no repayment is due even if the job ends early (§ 92(2) sentence 2 no. 5 SGB III)
- NOT for the subsidy period itself: that period (pay, interruptions, payslips) is settled with the final declaration (Schlusserklärung, BA EGZ 07a)
- NOT on the paper form if you applied through your online account: the declaration can then be submitted directly from the case overview
Worked example
Heizungsbau Roth GmbH after a 24-month subsidy for a 58-year-old fitter
Klaus Brenner was 58 when the subsidy began; the employment agency granted the integration subsidy for 24 months, which is possible from age 55 if the subsidy began by 31 December 2028 (§ 89 sentence 3 SGB III) — in this example EUR 800 a month, EUR 19,200 in total. The retention period is not 24 but twelve months (§ 92(2) sentence 5). Case 1: Mr Brenner is still there after those twelve months. Roth GmbH submits the declaration: employment continues, contact person, place, date, signature — done. Case 2: in the sixth month of the retention period Roth GmbH dismisses him because it wants to give the post to its own trainee; none of the grounds in sentence 2 applies. Repayment is capped at half of the amount paid, EUR 9,600, and may not exceed the amount paid in the twelve months before the employment ended (sentence 3). Those twelve months contained six subsidised months, EUR 4,800: that second cap bites, so the ceiling is EUR 4,800. Because six of the twelve unsubsidised retention months were served, this is taken into account pro rata (sentence 4); the actual claim is lower and is fixed by the agency. Case 3: Mr Brenner resigns to move to another firm, for a reason Roth GmbH is not responsible for — no repayment (sentence 2 no. 3). Amounts are illustrative.
How to fill it in, step by step
- Check in the grant notice, under conditions (Auflagen), when the retention period ends, and under submitting documents (Vorlage von Unterlagen) by when the declaration must arrive.
- If you applied online, submit the declaration directly from the case overview; otherwise complete form BA EGZ 08.
- Enter the office, file number (Ablagenummer), company name, customer number and the subsidised person's details.
- State whether the employment continues; if it does, go on to the contact person in the company.
- If it has ended, give when and with effect from which date, who ended it and the precise reasons — the agency tests the exceptions of § 92(2) sentence 2 SGB III against them.
- Date and sign, enclose a copy of the dismissal or termination agreement if the job ended, and submit the declaration — immediately if it ended early.
Good to know
- No repayment where the employer was entitled to dismiss for reasons of the employee's person or conduct, where a dismissal for urgent operational reasons was justified, where the employment ends at the employee's initiative for a reason the employer is not responsible for, where the minimum age for the statutory old-age pension has been reached, or where an especially affected severely disabled person was subsidised (§ 92(2) sentence 2 nos. 1 to 5 SGB III).
- Repayment has two caps, and the lower one applies: half of the total subsidy paid, and the amount paid in the twelve months before the employment ended (§ 92(2) sentence 3 SGB III). After a long subsidy, the second cap is often the tighter one.
- Unsubsidised retention time already served is taken into account pro rata (§ 92(2) sentence 4 SGB III): a dismissal near the end of the period costs less than one just after the subsidy ends.
- The repayment duty also applies DURING the subsidy period (§ 92(2) sentence 1 SGB III); that case, however, is reported with the final declaration, not on this form.
- The form itself warns: if you ended the employment early, the agency must check whether the benefits have to be partly repaid — so give the reasons precisely.
- According to the form, no signature is required when it is submitted through the online account.
Common mistakes
- Assuming the retention period matches a subsidy longer than twelve months. It is capped at twelve months (§ 92(2) sentence 5 SGB III).
- Submitting the declaration when the subsidy ends. It belongs at the end of the retention period; at the end of the subsidy the final declaration is due.
- Giving only a date when the job ended. Whether an exception in § 92(2) sentence 2 SGB III applies depends on the reasons; without them the repayment cannot be assessed.
- Treating a termination agreement as neutral. The statute exempts only an end at the employee's initiative for a reason the employer is not responsible for (sentence 2 no. 3) — a termination the employer wanted is not covered.
- Waiting for the retention period to run out when the job ended early. The form asks for the declaration immediately after the employment ends.
- Calculating repayment on the whole subsidy. It is capped at half, and also at the amount paid in the twelve months before the end (§ 92(2) sentence 3 SGB III).
Frequently asked questions
How long must I keep the subsidised person employed?
As long as the subsidy period, at most twelve months (§ 92(2) sentence 5 SGB III). The exact length is in your grant notice under conditions (Auflagen).
Do I need the paper form if I applied online?
No. The Federal Employment Agency states that you can then submit the continued-employment declaration directly online from the case overview and need not complete the form.
The employee resigned — do I have to repay anything?
Not if the employment ends at the employee's initiative for a reason you are not responsible for (§ 92(2) sentence 2 no. 3 SGB III). Describe the circumstances precisely in the declaration.
What is the most I can be asked to repay?
Half of the subsidy paid, but no more than the amount paid in the twelve months before the employment ended; unsubsidised retention time already served is taken into account pro rata (§ 92(2) sentences 3 and 4 SGB III).
Does repayment apply to subsidies for severely disabled employees?
Not for especially affected severely disabled people (§ 92(2) sentence 2 no. 5 SGB III). For other people with disabilities the other exceptions in sentence 2 apply.
