Declaration of non-conviction and filiation: free template

The declaration of non-conviction and filiation is required when registering a business with the French trade and companies register (RCS) and the national business register (RNE). The director declares that no conviction or sanction bars them from running a business, and states their filiation. No set form is imposed: a dated and signed declaration is enough — generate yours below, free of charge.

Deadlines

When the registration file is filed
The declaration goes with the file submitted to the single window: without it, the formality is incomplete.
For each new director
One declaration per person concerned: it is personal and does not pass from one director to the next.

Documents to prepare

  • Name in use and birth name
  • Date and place of birth
  • Home address
  • Father's name and mother's birth name

What you get

  • The same document in Word (.docx), so you can edit it before signing.

The generated document is written in French — the language the receiving French authority expects. This page is in English; the document itself is not translated.

Generate your document

Free. The document is generated on demand: your entries are not recorded in any of our databases and are only used to produce it. They travel in the request body, never in the page address.

All fields are required unless marked “optional”.

About you

As they appear on your identity document.

Why we ask this

You are the declarant: your name opens the document and your signature binds you.

To be filled in even where it matches your name in use.

Why we ask this

Filiation is checked against the birth name; a name in use alone is enough to get the declaration rejected.

Date of birth

The document will write it out in full.

Why we ask this

It identifies the person in the register, including among namesakes.

For example: 27 3 1990

Town, as it appears on your birth certificate.

Why we ask this

It completes the civil-status identification the register requires.

Number, street, postcode and town.

Why we ask this

The register ties the declaration to a person with an address, not to a bare name.

Your filiation

Use the exact civil-status wording.

Why we ask this

Filiation is the second required statement, on a par with non-conviction.

Her BIRTH name, never her married name.

Why we ask this

This is the most frequent omission, and the first cause of rejection.

Place and date of signature
Why we ask this

The place of signature closes the document, as expected of an administrative writing.

On (date)

Usually today's date, as close as possible to filing the application.

Why we ask this

The single window expects a declaration contemporaneous with the filing.

For example: 27 3 1990

A draft is a file you save wherever you like, just like the document itself: we keep no copy of it and nothing is left in your browser. When signed in, you can also save it to your space to pick it up later — only if you ask.

Document drafted by ActioFin; it carries no legal standing before the tax authorities. Read it through and adapt it to your situation before signing.

This document is signed by hand, after printing: we do not offer electronic signature. Only a qualified electronic signature, issued by a certified provider, carries the same weight as a handwritten one (eIDAS regulation). A mere click would not — and letting you believe otherwise would expose you the day a body challenges it.

Who this applies to

  • Anyone registering a business with the RCS or the RNE through the single business formalities window.
  • The director or permanent representative, depending on the legal form: they are the one who dates and signs the original.
  • Also required for certain changes of director during the life of the company.

Worked example

Example: Nadia registers her SASU

Nadia sets up a SASU and files her application with the single window. Besides the articles of association and proof of registered office, she needs a sworn declaration of non-conviction and filiation. She writes her birth name, her date and place of birth, her parents' names — her mother's under her birth name — then declares that no conviction bars her from directing a company. She dates it, signs it, and attaches it to the file. Without her mother's birth name, the formality would have been rejected.

How to fill it in, step by step

  1. State your full identity: name in use, birth name where different, date and place of birth, address.
  2. Fill in the filiation: your father's name and your mother's birth name — this is the item most often forgotten.
  3. Use the non-conviction wording: no criminal conviction and no civil or administrative sanction barring you from managing, administering or directing.
  4. Date and sign the original in your own hand: an unsigned declaration is worthless.
  5. Attach the declaration to the file submitted through the single business formalities window.

The template, item by item

Birth name
To be stated even where it matches the name in use. Filiation is checked against the birth name: a name in use alone is enough to get the declaration rejected.
Mother's birth name
It is indeed the birth name that is expected, not the married name. This is the most frequent omission.
Scope of the declaration
It covers the absence of criminal conviction and of civil or administrative sanction barring you from creating, managing, administering or directing a business — not the absence of any record whatsoever.

Good to know

  • No form is imposed: the model provided by the administration is a convenience, not a formal requirement. A dated and signed declaration carrying the right statements will do.
  • The declaration is personal: in a company with several directors, one is needed per person.
  • A false declaration exposes the signatory to the criminal penalties of article 441-7 of the Criminal Code — the notice appears at the foot of the generated document.

Common mistakes

  • Omitting the filiation and declaring only the absence of conviction: the document is then incomplete and the formality is rejected.
  • Giving the mother's married name instead of her birth name.
  • Having the declaration signed by someone other than the director concerned: it is personal.
  • Reusing a previous director's declaration when management changes.

Frequently asked questions

Is there a compulsory CERFA form?

No. The administration provides a model, but no form is imposed: a dated and signed sworn declaration carrying the identity, the filiation and the non-conviction wording is sufficient.

Why is filiation required?

It identifies the person unambiguously in the register, including among namesakes. That is why the mother's birth name is required rather than her married name.

What happens in the event of a false declaration?

It exposes the signatory to the penalties of article 441-7 of the Criminal Code — one year's imprisonment and a €15,000 fine — without prejudice to refusal or cancellation of the formality.

Is one declaration needed per director?

Yes. It is personal: each person called upon to direct, administer or represent the business draws up their own.
