Worked example

The lift and the ground floor

In one block the lift costs are split by co-ownership shares, although two flats are on the ground floor. The meeting resolves by simple majority that maintenance will in future be borne only by the units from the first floor up. The resolution concerns one type of cost and is covered by § 16(2) sentence 2 WEG. All other costs keep the old key.

Practical case

Advance and top-up payment for one flat

The doctor's flat from the introduction has a co-ownership share of 72/1,000; there is no different key. The business plan resolved for 2025 provided for costs of €54,000 and a reserve contribution of €9,000. The 2025 annual statement shows actual costs of €62,000; the reserve contribution stayed as planned. What was the flat's monthly advance payment, and what top-up payment can the meeting call in?

Hint: Add costs and reserve contribution, apply the share and divide by twelve. Then repeat the calculation with the actual costs.

Show the solution

Under the business plan the flat bears 72/1,000 of €63,000, that is €4,536 a year or €378 a month. Under the annual statement its share is 72/1,000 of €71,000, that is €5,112. It paid €4,536. The meeting resolves on the difference of €576 as a top-up payment under § 28(2) WEG. The €648 reserve share in it cannot be charged to the tenant.

Answer: €378 per month, top-up payment €576
