Registering the lease: the obligation, the deadline and the options

The explanation, in the order it is meant to be read · 40 sections · 1,829 words · 11 min

Chiara is letting the two-room flat she inherited from her grandmother in Padua: €7,200 a year, a 4+4 lease starting on 1 May 2026. She has signed with the tenant and believes the paperwork is done. In fact she has thirty days left to register the lease with the Agenzia delle Entrate, pay €144 of registration tax and put stamp duty on every copy.

What you will be able to do

  • Recognise which leases must be registered and which need not be
  • Meet the thirty-day deadline and settle who registers
  • Choose between online registration, the tax office or an intermediary
  • Prepare the documents and stamp-duty labels for the tax office
  • Fill in the F24 for first registration and recognise the codes used to put a late one right

An obligation that does not depend on the rent

The Agenzia delle Entrate's page leaves no room for doubt: every lease or rental of real property must be registered, including those on agricultural land and those signed by VAT-registered parties, whatever the agreed rent. A let bringing in a few hundred euros a year follows the same rule as an industrial warehouse.

The obligation rests on both parties. Either the tenant, who takes the property on, or the landlord, the owner, may register. In practice the owner often handles it, but the Agenzia's page does not put the duty on the owner alone. So agree in writing who registers, and ask the other party for proof that it was done.

There is a concrete reason. The Agenzia's page on the tax states that landlord and tenant are jointly liable for paying the whole amount due for registration. If the party meant to pay does not, the tenant cannot consider himself safe: the debt towards the tax authorities belongs to both of them, for the full amount.

Definition

Landlord and tenant — The landlord (locatore) grants use of the property and is usually the owner; the tenant (conduttore) receives it and pays the rent. For agricultural land Italian speaks of affitto and affittuario. The Agenzia's page uses these terms, along with locatario, to say who may apply for registration.

The one exemption: very short lets

Only one case escapes the obligation: residential leases that do not exceed thirty days in total over the year between the same parties. The limit is counted by adding up every period in the year with the same tenant, not contract by contract. Two stays of twenty days with the same person make forty days.

The exemption applies only to homes. A storeroom or an office let for two weeks remains subject to the general rule. Anyone letting a flat for short periods must also deal with the tax rules on short lets, which concern the owner's income tax rather than registering the lease.

Thirty days to register

The deadline is thirty days from the signing date, or from the start date of the lease if that comes earlier. A lease signed on 10 June with a start date of 1 June must therefore be registered within thirty days of 1 June. Signing after the tenancy has begun does not stretch the time available; it shortens it.

Key figures

Deadline for registering the lease
30 days
Longest yearly total, between the same parties, for an exempt residential let
30 days
Number of properties owned from which online registration becomes compulsory
10 (at least ten properties)

The deadline also applies to landlords who choose the cedolare secca flat tax: the lease must be registered all the same, and only what is paid changes. The second module explains what the option removes and what it leaves. What does not change is the deadline, nor the fact that late registration costs penalties and interest.

If, on the other hand, the lease is signed before its start date, say in March for a let beginning in May, the thirty days run from the signing. Registration may therefore come weeks before the tenant moves in. It happens, for instance, to a student who signs in spring for the following academic year.

Three ways to register

The first way is online, through the Agenzia's services: it requires a SPID digital identity, an electronic identity card or a national services card. The RLI application comes as software to install on a computer or as a web procedure, and it handles both registering the lease and paying registration tax and stamp duty.

The online route is compulsory for estate agents and for owners of at least ten properties; for everyone else it is optional, provided they are registered for the online services. The second way is the tax office: fill in the RLI form and go, by appointment, to any office of the Agenzia.

The office need not be the one for one's tax domicile: the Agenzia states that any office will do. The third way is to delegate. An authorised intermediary, such as a professional adviser, a trade association or a tax assistance centre, or simply a delegate, registers the lease on the parties' behalf.

Summary table

RouteFor whomWhat is needed
OnlineCompulsory for estate agents and owners of at least ten properties, optional for everyone elseSPID, CIE or CNS and the RLI application, installed or on the web
At the officeAnyone not required to register onlineRLI form, originals of the lease, stamps, registration tax receipt
Through an intermediaryAnyone who would rather rely on an adviser, an association or a tax centreThe mandate given to the authorised intermediary or delegate

For someone registering a single lease who already has a digital identity, the online route avoids an appointment and combines registration and payment in one step. The office remains useful for anyone without credentials or who prefers to hand documents over in person; an intermediary, for anyone who would rather have someone else fill in the form as well.

What to bring to the tax office

Anyone going to the counter must bring everything needed, because the office registers on the basis of what it receives. The Agenzia's page lists the documents to prepare before the appointment, and it pays to check them one by one the evening before:

  • at least two originals of the lease, or one original and a copy that the office will certify as matching
  • the application for registration, meaning the completed RLI form
  • the RR form listing the leases, when registering more than one
  • the electronic stamp-duty labels, issued no later than the signing date, on every copy
  • the receipt for the registration tax paid with the F24 Elementi identificativi form

Key figures

Stamp duty for each copy to be registered
€16 per 4 pages or 100 lines
Written pages covered by one stamp
4 (written pages)
Lines beyond which an extra stamp is needed in any case
100 (lines)

Stamp duty is €16 for every four written pages and, in any case, every hundred lines, for each copy to be registered. A short but densely written lease may therefore need more stamps than its page count suggests. The ActioFin calculator reads the rule by taking the higher of the two counts.

Instead of the F24 and the stamps, both taxes can be paid by asking for a debit to one's own account on the dedicated form. If registration happens on the spot, the office hands back the stamped and signed copy; if it is deferred, it issues a delivery receipt and says when the registered copy will be ready.

One detail about the stamps surprises many people: they must be bought on a date no later than the signing. Buying them on the day of the appointment, weeks after signing, breaks the rule. It is best to buy them before the signing meeting, counting the pages and lines of the final text.

New leases must also contain a clause in which the tenant declares having received the information and documents on the energy performance certificate, known as the APE. A copy of the APE must be attached to the lease, except for leases of single property units.

How to pay on first registration

The payment channel follows the registration channel. Whoever registers online pays registration tax and stamp duty by debit to a bank or post office account, within the same procedure. Whoever registers at the office pays the registration tax with the F24 Elementi identificativi form, or by debit request, and the stamp duty with the labels.

The general rules apply to the F24 Elementi identificativi: VAT number holders submit it online only, while others may also use a bank or post office. The taxpayer section shows who is paying and, alongside, the tax number of one counterparty with identifying code 63.

In the Erario section one writes the letter F, standing for registration tax, the tax code and the year the lease was signed, or started if earlier. The identifying details stay blank on first registration: the lease's code is created by registration itself, and it will be needed for every payment in later years.

Summary table

Tax codeWhat it is for
1500Registration tax on first registration
1507Ravvedimento penalties for late first registration
1508Ravvedimento interest for late first registration

The last two codes reveal something important: a late registration can be put right through ravvedimento operoso, paying a reduced penalty and interest on separate lines. The course on ravvedimento explains how the reductions work; the starting level of the penalty for late registration should be checked in the Agenzia's own sources.

One form for the whole life of the lease

The RLI form is not a one-off. After first registration, the Agenzia's page on later steps lists what still goes through it: payments for later years, extension, assignment and takeover, early termination and renegotiation of the rent. Registering, in practice, opens a file that stays open as long as the lease.

That is why the registered copy or the online receipt deserves careful keeping. It carries the lease's identification code, needed for every future payment with the F24 Elementi identificativi form. If it goes missing, the Agenzia says it can be retrieved with the dedicated lease code search function.

The cedolare secca option also goes through the RLI form, either on registration or in a later year. Whoever chooses it pays no registration tax or stamp duty, but still files the registration request on time. The second module explains in detail what changes, and for which steps.

Mistakes to avoid

  • Leaving a let unregistered because the rent is low: the obligation applies whatever the agreed amount.
  • Counting the thirty days from signing when the start date is earlier: the deadline runs from the earlier date.
  • Treating a short residential let as exempt without adding up every period of the year with the same tenant.
  • Buying the stamp-duty labels after signing: their date must be no later than the signing date.
  • Turning up at the office with a single original and no copy, or without a completed RLI form.
  • Thinking the tenant risks nothing if the owner fails to pay: landlord and tenant are jointly liable.
