Practical case

On what day does the employment end?

An employment has existed since 1 March 2015. The employer gives notice, and it reaches the employee on 10 April 2026. No collective agreement applies, and the employment contract says nothing about periods. On what day does the employment end?

Hint: First determine which step of subsection 2 is reached, then watch the end date that step prescribes.

Show the solution

On 10 April 2026 the employment has lasted eleven years and a good month. The step reached is therefore the ten-year one, not the twelve-year one: the period is four months. Unlike under the basic rule in subsection 1, the only permissible end date is the end of a calendar month. Four months from receipt lead into August; because the period must expire at month end, the employment ends not in mid-August but on its final day.

Answer: on 31 August 2026
