Practical case

The painting firm drafts its second contract

The painting firm from the opening wants to get it right with its second apprentice. The contract is signed on 12 May 2026, training starts on 1 August 2026 and is scheduled to end on 31 July 2029. The owner would like a six-month probation period to be on the safe side. What is the longest probation she may agree, and until what date at least must she keep the record and the proof of receipt if training ends as scheduled?

Hint: Probation is governed by section 20 BBiG. For retention, what counts is not the year of hiring but the year in which the training relationship ends.

Show the solution

Section 20 BBiG limits probation to at least one and at most four months. Six months would depart from the Act to the apprentice's disadvantage and would be void under section 25; the owner therefore writes at most four months into the contract. Under section 11(2) the record and the proof of receipt must be kept for three years, counted from the end of the year in which training ends. It ends in 2029, that year runs out on 31 December 2029, and the three years end on 31 December 2032.

Answer: at most 4 months of probation; keep the documents until at least 31 December 2032
