Practical case

How much and for how long?

A sales employee is 52 when her claim arises and has no children. Over the last 60 months she was in compulsorily insured employment for 34 months. The agency sets her benefit pay at 80 euros per calendar day. She notified the agency as a job seeker too late. What is her monthly unemployment benefit, what duration does the table give, and what does the late notification cost?

Hint: First choose the benefit rate, then the table row where both insured months AND age are met. The suspension period acts on the duration through § 148(1) no. 3.

Show the solution

Without a child the general rate of 60 per cent applies: 80 × 0.60 = 48 euros per calendar day. A full month counts as 30 days under § 154, so 48 × 30 = 1,440 euros. In the table she meets the row with 30 months and age 50; for 36 months she lacks both insured months and the age of 55. The duration is 15 months. The late job-seeker notification triggers a one-week suspension, which shortens the duration by seven days: 7 × 48 = 336 euros.

Answer: 1,440 € a month, 15 months minus 7 days, a loss of 336 €
