Temporary agency work for lenders and hirers
Anyone who lends employees to other businesses or uses agency workers is operating under the Temporary Agency Work Act. The first module explains when agency work applies, who needs a licence and which exceptions small businesses can use, how the lending contract must be labelled and how the 18-month maximum period is counted. The second covers equal pay and its limits under collective agreements, the hirer's own duties, the deemed employment relationship when lending is void, liability for contributions and wage tax, and the fines.

By the end of this course, you can…
These outcomes are the modules' own: the promise cannot say anything the course does not teach.
- recognise when using outside workers is temporary agency work rather than a contract for work
- apply the licence requirement and the exceptions in section 1(3) and section 1a AÜG to your own business
- place the application, time limit, renewal and expiry of a lending licence on a timeline
- draft the lending contract so that labelling and naming of the worker are settled before the first working day
- calculate the maximum assignment period, including earlier assignments that are counted
- place the equal treatment principle of section 8 AÜG and its deviations by collective agreement
- determine the time limits on a pay deviation for an assignment
- meet your own duties as hirer on health and safety, vacancies and shared facilities
- recognise when an employment relationship with the hirer arises and how the declaration of adherence works
- estimate liability for contributions and wage tax and the fine ranges in section 16 AÜG
