Wage garnishment (saisie sur rémunération)

Enter the employee's monthly net pay and their dependants: the calculator applies the statutory attachable-share scale — the one that governs garnishments enforcing a debt other than unpaid maintenance — checks the amount that must be left to them, and returns the exact sum to remit each month.

Calculation assumptions

  • Only one kind of debt is modelled: a garnishment enforcing a debt OTHER than unpaid maintenance (pension alimentaire). The official page separates the two regimes — the maximum amount of a wage garnishment differs according to whether it enforces unpaid maintenance or another debt — and, for unpaid maintenance, sets the scale aside: the attachable income may then be seized in full, save for the solde bancaire insaisissable (SBI). That second regime is not computed here, and it is not computed because no readable rule is served to an employer: the sum it leaves to the debtor is the SBI, an amount a bank leaves on an ACCOUNT, served as a minimum rather than as a fixed figure; the fiche that governs the employer's obligations says nothing about it; and a maintenance creditor may prefer the paiement direct procedure, itself out of scope. Applying the scale below to unpaid maintenance withholds far less than the law allows.
  • The base is an input, not a computation: it is the average of the last twelve months of NET pay, after withholding tax, excluding expense reimbursements and family allowances. Where the employee has been with the company for less than twelve months, the average is prorated over the months actually worked.
  • The calculation applies the fraction insaisissable — the flat-rate RSA amount for a single person — which must be left to the employee whatever the scale produces. The solde bancaire insaisissable is a DIFFERENT concept: a sum a bank leaves on an account when the account itself is attached. It is not modelled here.
  • A single enforcement title is modelled. Not covered: several concurrent garnishments or wage assignments, tax authority attachment notices (SATD), direct payment of maintenance (which ranks first and may reach into the fraction insaisissable), and multiple employers, which requires the calculation to cover all earnings together.
  • The calculation returns a THEORETICAL MONTHLY deduction, based on the average of the last twelve months. It does not model the limit of the sums actually available in the month of the deduction: the employer sets that, pay slip by pay slip, because the engine does not ask for the month's net pay. In a month paid well below the average, the actual deduction is therefore lower than the one shown here — never higher.
  • The bracket ceilings are the monthly figures published in the official table, rounded to the cent from annual thresholds. At the exact ceiling of the fourth bracket, the deduction recomputed from those rounded monthly thresholds lands one cent below the "maximum" the table prints; the gap exists only at that single point, and in the employee's favour. The calculator owns the gap rather than closing it — rebuilding the annual thresholds would bring into the computation a figure no official page we read publishes — and it flags the gap on screen at the exact point where it arises.
