Calculation assumptions

  • The uplift rates (10% then 25%) and the quota applied here are the ones that apply IN THE ABSENCE of a collective agreement. An industry-wide or company agreement may set a different uplift rate and raise the quota to one third of the contractual working time: this is the single most important limit of this calculation, and the applicable agreement always prevails over the figure shown.
  • The figures are GROSS: no social security contributions, no net pay, no income tax — see the "employee social contributions" and "payroll simulator" calculators. It covers neither overtime on a full-time contract (which has its own calculator), nor working-time arrangements spread over a period longer than the week, where the quota is assessed over that period rather than week by week, nor the specific regime of household employers and childminders.
  • The reclassification threshold used here is the STATUTORY working time of 35 hours a week. A lower contractual working time set by agreement produces the same effect and is not modelled: if your industry sets a collective duration below 35 hours, that is the figure to compare against. The rule is the one stated by the Ministry of Labour fact sheet "Le travail à temps partiel : contrat et statut du salarié", cited as the source: additional hours may not bring the working time actually performed up to the statutory duration, a public-policy provision from which the Court of Cassation, in a ruling of 15 September 2021, drew the reclassification of the contract as a full-time contract. The articles of the labour code themselves could not be read directly — Légifrance refuses automated reading.
  • The "complément d'heures" amendment (a temporary contractual increase in working time) is costed as an ALTERNATIVE, with the hours paid at the contract rate: that is the regime that applies absent any provision to the contrary. A collective agreement, an industry-wide agreement or the amendment itself may provide for an uplift, which is not modelled here; hours worked beyond the agreed increase remain additional hours and stay uplifted. Nor may the amendment bring working time up to the statutory level.
  • Durations are rounded to the nearest minute and ceilings rounded down to the minute — a maximum is never rounded up. The monthly cost is the weekly cost annualised and spread over the year (× 52 / 12): it assumes a typical week repeated, whereas additional hours vary from one week to the next in practice.
