📋Overview+
The Organisation of Working Time Act 1997 regulates maximum working hours but does NOT mandate a premium rate for overtime. Employees are entitled only to whatever rate is set out in their contract of employment or an applicable Employment Regulation Order (ERO) or Sectoral Employment Order (SEO) for their sector — a common but non-statutory practice is 'time and a half' (50% premium). Registered Employment Agreements (REAs) no longer bind non-signatory employers sector-wide since McGowan v Labour Court [2013] IESC 21.
