Practical case
How large is the employer's top-up?
A bookkeeper earned average net pay of 75 euros per calendar day in the three settled calendar months before the protection period began. She is a member of a statutory health insurance fund. A single child is born on the calculated date, with no other special circumstances. How much does the employer pay per calendar day, and how much over the whole period?
Hint: Separate the amount the health fund bears at most from the remainder. For the duration, count both protection periods plus one further day that section 20 MuSchG names expressly.
Show the solution
Under section 24i(2) of Book Five the health fund pays at most 13 euros per calendar day. Under section 20(1) MuSchG the employer pays the difference between 13 euros and the net pay of 75 euros, that is 62 euros per calendar day. Payment covers the six weeks before delivery, the day of delivery and the eight weeks after: 42 days, one day and 56 days, 99 calendar days in all. The top-up therefore comes to 62 × 99 = 6,138 euros.
Answer: €62 per calendar day, €6,138 in total
