Worked example
Paola's disproportion argument
The 8,000 € of extra tax at Paola's company comes from consultancy fees genuinely paid but supported by an invoice addressed by mistake to a sister company. Full penalty: 70 % of 8,000 € = 5,600 €. If the office accepts a manifest disproportion, it can cut the penalty to one quarter: 5,600 / 4 = 1,400 €. The reduction is not automatic: it has to be requested and argued, documents in hand.
Practical case
A cost deducted one year early
A sole trader deducted in 2025 a cost belonging to 2026. The audit recalculates 1,200 € of extra personal income tax for 2025, but the marginal rate is identical in both years and the cost would have been deducted in 2026 with the opposite effect. What penalty does the trader face, and why is it not 70 %?
Hint: Look in article 1 of Decree 471 for the rule on timing errors.
Show the solution
This is a timing error on a deductible item. Where the conduct caused no loss to the Treasury, because the combined tax over the two years is unchanged, paragraph 4 of article 1 sets the penalty at 250 €, in place of 70 % of the extra tax. Seventy per cent of 1,200 € would have been 840 €.
Answer: A flat penalty of 250 €, instead of 840 €.
Practical case
A small understatement
A limited company declared 60,000 € of tax; the audit finds 1,500 € of extra tax, caused by entertainment costs deducted above the permitted limit. There are no false documents and no fraudulent conduct. What penalty applies to the extra tax?
Hint: Compare the extra tax with three per cent of the tax declared and with the absolute threshold.
Show the solution
The base penalty is 70 % of 1,500 €, or 1,050 €. The extra tax equals 2.5 % of the tax declared, below three per cent, and is under 30,000 €: paragraph 4 of article 1 reduces the penalty by one third. 1,050 − 350 = 700 €, above the 150 € minimum.
Answer: 700 €, that is 70 % reduced by one third.
Practical case
The return that arrived late
A self-employed professional files a return twenty-two days after the deadline. No tax is outstanding, because the withholdings suffered cover everything. Which rule of Decree 472 softens the penalty for the delay, and with what effect?
Show the solution
Article 7, paragraph 4-bis, of Decree 472 provides that, unless a specific law says otherwise, the penalty is cut to one third when a return is filed within thirty days of the deadline. Twenty-two days fall inside that window: whatever penalty applies to the delay drops to one third.
Answer: The penalty for the delay drops to one third, under article 7, paragraph 4-bis.
