Worked example

The arrears that block the estate agent's permit

The caretaking business from the opening does not pay the 8,400 €, discloses its owner's assets and still does not settle the claim during the following month. The enforcement authority orders his entry in the debtors' register. If he now applies for a permit under section 34c GewO, the rule in subsection 2 no. 2 counts against him. If he pays in full and proves it, the entry can be deleted early.

Practical case

Which tier applies to three new activities?

A business owner runs an online shop for home accessories. She plans three extensions: buying and reselling used high-value cameras through a specialised shop, managing rented flats for two landlords, and selling home contents insurance for commission. Which tier of the Trade Regulation Act applies to each, who checks when, and what must she hold before the first transaction?

Hint: Match each activity to a provision, then ask whether the check happens before or after the start.

Show the solution

Buying and selling high-value consumer goods such as cameras through a specialised second-hand business requires supervision under section 38(1) GewO. She notifies it, may start, and must apply without delay for a certificate of good conduct and a central trade register extract to be sent to the authority. Managing rented flats for third parties requires a permit under section 34c(1) sentence 1 no. 4 GewO, with proof of professional liability insurance. Brokering insurance requires a permit under section 34d(1) GewO, granted by the chamber of industry and commerce. Before the first transaction she therefore needs two permits; for the second-hand trade, notification followed by the check is enough.

Answer: Two permits in advance (sections 34c and 34d); for the second-hand trade, notification followed by a check (section 38)
