Practical case

New windows in a young house

The Brandt family began building their detached house on 1 June 2016 and have lived in it exclusively themselves since 2017. They want a glazing firm to replace the windows; the new windows have a Uw value of 0.9 W/(m²K). The firm could install them in April 2026 or in September 2026. Which date meets the conditions of § 35c, and why?

Hint: For each date, compare the age of the house with the threshold in paragraph 1 sentence 2, then check the remaining conditions.

Show the solution

Paragraph 1 sentence 2 requires the property to be older than ten years when the measure is carried out, counted from the start of construction. The house reaches ten years on 1 June 2026. In April 2026 it is only nine years and ten months old, so the early date fails. In September 2026 it is older than ten years. The other conditions are met: the family uses the house exclusively themselves, replacing windows is a measure under sentence 3 number 4, glazing is one of the trades in § 2 ESanMV, and 0.9 W/(m²K) is below the maximum of 0.95 W/(m²K) in Annex 4 number 4.1. The measure is also completed before 1 January 2030.

Answer: Only installation in September 2026: in April the house is not yet ten years old.
