German reinvestment reserve (EStG s. 6b) — rollover and profit surcharge

A gain on land can be rolled over into land or buildings; a gain on a building only into buildings. The reserve lasts four financial years, six for a new building started in time. If it is released without a rollover, profit is increased by 6 per cent for each full financial year it existed.

Calculation assumptions

  • Profit is determined by balance-sheet comparison, and the deduction and reserve can be traced in the accounts (EStG s. 6b(4) sentence 1 nos. 1 and 5).
  • The calculation follows the reserve route of EStG s. 6b(3); an immediate deduction in the year of sale under subsection 1 gives the same rollover amount, without surcharge, for the same reinvestment.
  • Only land and buildings are covered. Standing crops, inland vessels, shares (subsection 10), extensions and conversions, urban redevelopment (subsection 8) and instalment payment for EU reinvestment (subsection 2a) are not.
  • The deadline extensions of EStG s. 52(14) only concern reserves due for release in 2020 to 2022 and are not applied; nor is the restriction in s. 6b(4) sentence 2.
