German rent increase after modernisation — 8 per cent, capped per m²
The landlord may raise the annual rent by 8 per cent of the costs spent on the flat, after removing the share that ordinary repairs would have cost and any subsidies. Over six years the monthly rent may not rise by more than EUR 3 per square metre, or EUR 2 where the rent before the increase was under EUR 7 per square metre.

Calculation assumptions
- Costs are entered for the individual flat; the apportionment between several flats (BGB s. 559(3)) is assumed done.
- Under the simplified procedure the EUR 10,000 threshold is tested after deducting third-party funds, since BGB s. 559a(1) excludes them from the costs incurred. The statute does not say so in terms.
- The special rules for installing a heating system (BGB s. 559(3a) third sentence and s. 559e), with their own cap per square metre, are not modelled.
- A tenant's hardship objection (BGB s. 559(4)) is not assessed.
- Under the simplified procedure, no modernisation costs are assumed to have been claimed in the last five years that would reduce the EUR 10,000 threshold under BGB s. 559c(2).
