German residential lease notice — end date under BGB s. 573c

If notice is received by the third working day of a month, the tenancy ends at the close of the month after next. For the landlord the period grows by three months after five and again after eight years since the flat was handed over — for the tenant, never.

Calculation assumptions

  • This covers ordinary notice on an open-ended residential lease. Housing let for temporary use, furnished rooms within the landlord's own flat (s. 573c(2) and (3)) and termination for cause are not covered.
  • The statute does not define a working day. You enter which working day of the month the notice arrived on; Sundays and public holidays do not count, and holidays differ between Länder.
  • Years since the flat was handed over are counted as at the date the notice is received.
