Italian VAT on selling a building — taxable, exempt or reverse charge

A business selling a building is normally exempt from VAT. VAT applies when the business that built or renovated the building sells it within five years of completing the work, or when the seller opts for VAT in the deed: for homes, only the builder (or a seller of social housing) can opt; for business premises, any business can. When the sale is taxed by option and the buyer is VAT-registered, the buyer pays the VAT under the reverse charge.

Sources and assumptions

Calculation assumptions

  • The seller is a business or other VAT-registered person selling the building in the course of its business.
  • Enter the full years since the construction or works were completed: the sale is "within five years" until five full years have passed. The exact fifth anniversary should be checked against the deed.
  • Business premises are taxed at the standard rate; the reduced rates in Table A for some buildings ("Tupini" buildings, rural buildings) are not applied.
  • The sale takes place in 2026, so Presidential Decree 633/1972 applies. The new consolidated VAT code (Legislative Decree 10/2026) applies from 1 January 2027.
  • Not included: registration, mortgage and land registry taxes, the adjustment of the seller's input VAT when the sale is exempt, and sales of land.
