Supplementary sheet for family members to the German insolvency pay application (Zusatzblatt Familienangehörige)

Only employees receive insolvency pay (Insolvenzgeld). If you worked in the insolvent business as the owner's spouse, civil partner, child or other relative, the employment agency therefore first checks whether your work was employment (Beschäftigung) — non-self-employed work, with instructions and integration into the work organisation as the indicators (section 7(1) SGB IV). If the Deutsche Rentenversicherung has already established this in a status determination procedure, submit its decision; otherwise attach the supplementary sheet for family members (Zusatzblatt "Familienangehörige") to your insolvency pay application (Federal Employment Agency page for employees). The sheet extends no deadline: the application remains bound to the two months after the insolvency event (section 324(3) SGB III).

Deadlines

With the application: two months after the insolvency event
Section 324(3) sentence 1 SGB III — the sheet belongs to the insolvency pay application and has no deadline of its own; if you are waiting for a status decision, still file the application in time
Deadline missed through no fault of your own: two months after the obstacle ceases
Section 324(3) sentences 2 and 3 SGB III
Status determination: no cut-off in section 7a(1)
The parties may apply to Deutsche Rentenversicherung Bund in writing or electronically for a decision (section 7a(1) sentence 1 SGB IV); subsection 1 sets no deadline for this

Who this applies to

  • Family members who worked in the insolvent business and apply for insolvency pay without a Deutsche Rentenversicherung decision on their status (Federal Employment Agency pages for employees and for employers)
  • Spouses, civil partners and descendants of the employer: for them the collecting agency (Einzugsstelle) must apply for a status determination as soon as the relationship appears from the employer's notification (section 7a(1) sentence 2 SGB IV) — once that decision exists, the sheet is not needed
  • The employer who employs a relative: already in the registration notice, the employer must state whether the employee is a spouse, civil partner or descendant (section 28a(3) sentence 2 no. 1 letter d SGB IV)
  • NOT anyone who already holds a Deutsche Rentenversicherung decision finding employment: the decision suffices and the supplementary sheets are not needed (Federal Employment Agency page for employees)
  • NOT the managing shareholder as such: for them the Federal Employment Agency names the supplementary sheet for shareholders and managing directors (Zusatzblatt "Gesellschafter(in)/Geschäftsführer(in)") — a relative who is also a managing shareholder encloses both
  • NOT a substitute for the application: the sheet is filed WITH the insolvency pay application, not instead of it

Worked example

Sabine Kerner, the master joiner's wife, and the dismissal for lack of assets

For six years Sabine Kerner has worked in the office of her husband Uwe Kerner's joinery, a sole proprietorship: five days a week, 30 hours, for 2,100 euros gross a month, paid into her own current account. She prepares quotes and invoices as her husband directs and is integrated into the workflow like an outside office worker. In June the insolvency court dismisses the petition to open proceedings for lack of assets — the insolvency event (section 165(1) sentence 2 no. 2 SGB III). Within two months Sabine applies for insolvency pay (section 324(3) SGB III) and states there that she was a working family member. There is no Deutsche Rentenversicherung decision: the collecting agency should have applied for a status determination because her husband had flagged her as his spouse in the registration (section 7a(1) sentence 2, section 28a(3) SGB IV), but it did not. So Sabine encloses the supplementary sheet and describes her work on it. The agency checks whether the indicators of section 7(1) SGB IV are present — instructions and integration. The Insolvenzgeld calculator shows which months would be covered.

How to fill it in, step by step

  1. Find out whether the Deutsche Rentenversicherung has already determined your status — if its decision exists, submit it and the sheet is not needed (Federal Employment Agency page for employees).
  2. File the insolvency pay application in time, within two months after the insolvency event (section 324(3) SGB III), even if the status question is still open.
  3. Download the supplementary sheet for family members from the Federal Employment Agency page, or fill it in here.
  4. Describe your work so that the indicators of section 7(1) SGB IV can be checked: whose instructions you followed and how you were integrated into the work organisation.
  5. Do not leave out circumstances that might speak against employment — the decision rests on an overall assessment of all the circumstances of the case (section 7a(2) sentence 1 SGB IV).
  6. If you were also a managing shareholder, enclose the supplementary sheet for shareholders and managing directors as well.
  7. Sign the sheet and file it together with the application at your employment agency.

Good to know

  • Employment is non-self-employed work, in particular under an employment relationship; the indicators are work under instructions and integration into the instructing party's work organisation (section 7(1) SGB IV).
  • For family members helping in the business and managing shareholders, the Deutsche Rentenversicherung checks whether there is an employment relationship; where that has not happened, the supplementary sheets must be filed with the application (Federal Employment Agency page for employers).
  • Where the employer's notification shows the employee is a spouse, civil partner or descendant, the collecting agency applies for the status determination on its own initiative (section 7a(1) sentence 2 SGB IV) — the information is part of the registration (section 28a(3) sentence 2 no. 1 letter d SGB IV).
  • Deutsche Rentenversicherung Bund decides on an overall assessment of all the circumstances of the individual case (section 7a(2) sentence 1 SGB IV) — no single feature decides on its own.
  • When assessing compulsory insurance arising from the working relationship, other insurance bodies are bound by the decision of Deutsche Rentenversicherung Bund (section 7a(2) sentence 4 SGB IV).
  • Insolvency pay is for employees who worked in Germany (section 165(1) sentence 1 SGB III) — which is why, for a relative, everything turns on whether there was employment.
  • The Insolvenzgeld calculator works out the amount and the covered period under sections 165 and 167 SGB III — this guide repeats none of its values.

Common mistakes

  • Holding back the insolvency pay application until the status is settled. The two-month exclusion period runs from the insolvency event (section 324(3) SGB III).
  • Leaving out the sheet because you consider yourself an ordinary employee. Without a Deutsche Rentenversicherung decision, the Federal Employment Agency requires it from working family members.
  • Leaving out circumstances that might speak against employment. All the circumstances of the case are assessed (section 7a(2) sentence 1 SGB IV).
  • Confusing the family members' sheet with the one for shareholders and managing directors — a relative who is also a managing shareholder encloses both.
  • Not enclosing the Deutsche Rentenversicherung decision although it exists: with it, the supplementary sheets are not needed.

Frequently asked questions

As the boss's wife, can I get insolvency pay at all?

Yes, if you were employed — non-self-employed, following instructions, integrated into the work organisation (section 7(1) SGB IV) — and the other conditions are met. The agency checks this from the supplementary sheet, unless the Deutsche Rentenversicherung has already decided it.

When do I not need the sheet?

When the Deutsche Rentenversicherung has already found that there is an employment relationship: submit its decision and the supplementary sheets are not needed (Federal Employment Agency page for employees).

Shouldn't the status question have been settled earlier?

For spouses, civil partners and descendants, yes: where the relationship appears from the employer's notification, the collecting agency must apply for a status determination (section 7a(1) sentence 2 SGB IV). If the decision is still missing, fill in the sheet.

Does the sheet have a deadline of its own?

No. It belongs to the insolvency pay application, which is subject to the two-month exclusion period after the insolvency event (section 324(3) SGB III).

I am a relative and also a managing shareholder. Which sheet?

Both: the Federal Employment Agency names the family members' sheet for working relatives and the shareholders and managing directors' sheet for managing shareholders — unless a Deutsche Rentenversicherung decision exists.
