German home loans: withdrawal, early repayment, notice

What a consumer real estate loan is under German law, what the bank owes before signature and how it must assess creditworthiness. Then the 14-day withdrawal period, how its start can be delayed and its absolute end after twelve months and 14 days, and the seven-day reflection period before a notary. The second module covers early repayment with a legitimate interest, early repayment compensation with no percentage cap and its exclusions, the termination right after ten years and default interest of 2.5 percentage points above the base rate. Two modules with worked case studies.

Figures are tied to dated, sourced tax constants. A module whose rules have changed is flagged for review, and is unpublished automatically beyond 90 days.

By the end of this course, you can…

These outcomes are the modules' own: the promise cannot say anything the course does not teach.

  • recognise whether a loan is a consumer real estate loan under section 491(3) of the German Civil Code (BGB), and which protective rules attach to it
  • request and check what the bank owes before signature: the ESIS sheet, a draft contract and explanations
  • understand the standard against which the bank must assess creditworthiness, and what a breach means for interest and termination
  • work out to the day when the withdrawal period starts, how long it runs and when it ends at the latest
  • tell the reflection period for a notarised loan apart from the withdrawal period
  • check whether and when a fixed-rate home loan may be repaid early
  • apply the conditions, limits and exclusions of early repayment compensation under section 502 BGB
  • use the termination rights after ten years and at the end of the fixed-rate period on time
  • ask for, and use, the notice the bank owes before the fixed-rate period ends
  • determine default interest on a home loan and work out the threshold at which the bank may terminate for arrears
