The POS link, penalties and using takings data for VAT

The explanation, in the order it is meant to be read · 39 sections · 1,762 words · 10 min

Luca runs a hardware store in Verona. One afternoon he took 1,220 € by card without recording the sales on his till, which stayed off after a power cut. For each unrecorded sale the penalty is 70 per cent of the VAT, never less than 300 €. And since 2026, card payments and till data sit side by side in the Agenzia's systems.

What you will be able to do

  • Link the telematic till to electronic payment terminals in the Fatture e Corrispettivi portal
  • Meet the linking deadlines for a new or replaced card terminal
  • Tell substantive breaches from purely formal ones, and the penalty for each
  • Work out taxable amount and VAT from gross takings at each rate
  • Set up a monthly check that catches mistakes before an audit does

Linking the till to the POS from 2026

Italy's 2025 budget law made it compulsory to link telematic tills with electronic payment instruments, for transactions carried out from 1 January 2026. The aim is to place, side by side in the Agenzia's systems, what the till declares and what customers actually paid by card or other electronic means.

The link is not a cable. After consulting trade associations, the Agenzia opted for a virtual pairing: an online service in the reserved area of its website, switched on in March 2026. Meeting the duty does not require a new card terminal or a technician to open up the till.

Definition

RT-POS pairing — The record, made by the trader in the Fatture e Corrispettivi portal, associating the serial number of a telematic till registered with the tax registry and the identifiers of the electronic payment instruments held in the trader's name. An intermediary can make it on the trader's behalf.

In practice, the trader logs into the portal and opens the service called Gestione collegamenti. It displays the payment instruments registered to that trader, which the financial operators have already reported to the Agenzia. Each one just has to be matched with the right till, without typing long codes by hand.

Traders who use the documento commerciale online web procedure instead of a till make the pairing in the same service. The Agenzia has published an illustrated step-by-step guide and a set of FAQs, which explain for instance that one terminal may be linked to several tills, and which identifiers are needed.

The FAQs also cover an exclusion. A trader who uses the terminal only to take payment for transactions exempt from the commercial document need not pair it. A newsagent accepting cards for newspapers alone is the classic case; once the same terminal takes payment for anything else, the exclusion no longer applies.

Pairing deadlines

For instruments already in use on 1 January 2026, or used between 1 and 31 January 2026, the Agenzia's press release allowed forty-five days from the launch of the service: the first pairing had to be completed by 20 April 2026. Any trader who has not yet done it should put it right promptly, with their adviser's help.

Once the system is running, a rolling rule applies. For a first pairing or a change, the record is made from the sixth day of the second month after the month in which the instrument became available, and by the last working day of that same month. Not earlier, because the new terminal's data must reach the Agenzia first.

The same window comes round for every later change: whenever a payment instrument in the trader's name changes, the pairing is updated with the same calculation. A business with several outlets does well to keep an up-to-date list of till serial numbers and the terminals linked to each of them.

Penalties for recording and sending

The guide points to Legislative Decree 471 of 1997. The most serious breach is failing to record or send, or doing so late, or recording and sending incomplete or untrue data. Article 6, paragraph 2-bis, punishes it for each transaction with 70 per cent of the corresponding VAT.

Paragraph 4 of the same article sets a floor of 300 euro. On a café espresso, 70 per cent of the VAT is a few cents, yet the penalty does not drop below that floor. It is the minimum, more than the percentage, that makes small repeated omissions expensive.

The words for each transaction matter as much as the rate. The floor applies not once a day but to every sale left unrecorded: ten forgotten sales make ten minimums. That is why a till left switched off for an afternoon can cost more than a year of maintenance.

Tampering with or altering the till
3,000 € – 12,000 €

One transaction is not punished twice. Where late or missing transmission follows an inaccurate recording of the same sale, the penalty applies once: the guide relies on circular 3 of 2020, and paragraph 5 of article 6 says the same in general terms whenever several duties attach to a single transaction.

A broken till is no excuse. Failure or faulty operation of the equipment carries the same 70 per cent, subject to the fallback procedures set out in the implementing measures. If no sales were left unrecorded, however, failing to call for repairs in time or skipping the periodic inspection costs between 250 and 2,000 euro.

When the error does not affect the VAT settlement, the breach is formal. Think of a late or incomplete transmission that leaves the VAT due unchanged. A fixed penalty of 100 euro per transmission then applies, up to 1,000 euro a quarter, and the guide states that the rules merging several penalties into one do not operate here.

Licence suspension and tampering

Substantive breaches also bring an ancillary penalty: suspension of the licence or authorisation to trade, or of the business itself. It lasts from three days to one month, or from one to six months if the takings in dispute exceed 50,000 euro in total. For a shop, even a week's enforced closure hurts more than the fine.

Anyone who tampers with or alters a till, uses a tampered one, or lets others use it to dodge the rules faces 3,000 to 12,000 euro, unless the conduct is a crime. On top comes suspension of the licence for fifteen days to two months, rising to between two and six months for a repeat offender.

A trader who spots their own mistake before the Agenzia does can cut the penalties through ravvedimento operoso, Italy's voluntary correction scheme. How it works, with its reduction fractions and the exceptions that concern receipts in particular, is covered in a dedicated course: here it is enough to know that speed pays.

From takings to the VAT settlement

Recorded takings are gross figures: the price the customer paid already contains VAT. The periodic settlement needs the tax itself, which is extracted by reverse calculation. Divide the gross amount by one plus the rate written as a decimal to get the taxable amount; the difference from the gross figure is the output VAT.

The extraction is done rate by rate, never on a single mixed total. That is why the till's departments must be set up correctly: a bar selling coffee and spirits under the wrong departments transmits data that does not match the VAT really owed, and the error passes straight into the settlement.

The Fatture e Corrispettivi portal helps here too. Besides sending data, it lets the trader view takings records, as article 2 of Legislative Decree 127 of 2015 provides, and it offers pre-filled VAT documents. An adviser finds the totals by rate there without asking the client for rolls of till paper.

Rounding needs some care. Extracting VAT at each rate often produces figures beyond the cent: round the final result, not every single sale. Comparing your own totals with those the portal shows by rate then reveals a badly configured department before the mistake finds its way into the settlement.

A four-step monthly check

  • open the Fatture e Corrispettivi portal and confirm that every trading day has its transmission
  • compare the month's transmitted total with cash taken and with card credits from the terminal
  • check the split by VAT rate, especially after the till departments have been changed
  • confirm in Gestione collegamenti that every active terminal is paired with the right till

Comparing against card credits has become the most telling step. If, in a given month, cards brought in more than the till reported, something went unrecorded. Far better to find that out yourself, while a voluntary fix is still open, than to read it in a letter from the Agenzia.

The check can be handed to an adviser. The portal allows its services to be delegated to an intermediary, who sees the same data as the trader. Still, the owner should look at the monthly totals in person: only they know whether the shop was open on those days, shut for holidays or stopped by a fault.

The amounts described were read on the Agenzia's pages and in the text of article 6 of Decree 471 published in the Gazzetta Ufficiale in September 2026. The Gazzetta marks that decree as repealed by the consolidated text on tax penalties, Legislative Decree 173 of 2024: check the amounts in force before applying them to future breaches.

Mistakes to avoid

  • Assuming the till-to-POS link needs a cable or a technician: it is an online record in the Gestione collegamenti service.
  • Pairing a new terminal the day it goes live: the window opens on the sixth day of the second month after.
  • Applying the 70 % penalty to the gross price instead of the transaction's VAT, and forgetting the 300 € floor.
  • Extracting VAT from the daily total at a single rate when the shop sells goods at different rates.
  • Neglecting till maintenance: even with no sales left out, failing to call for repairs is penalised.
