Self-correction and ruling requests: getting an error fixed and asking before you act
The module’s worked examples, then cases to attempt before revealing their solution · 5 sections · 417 words · 6 min
Worked example
Paolo's notice
Paolo attaches to his request the receipt of the F24 with which he paid the 2,400 € and sends it by certified email to the office that issued the notice. The defect is a failure to take into account a payment properly made, so cancellation is mandatory. Meanwhile he notes the appeal deadline, because the request does not move it by a single day.
Worked example
A shop's ruling request
The owner of a furniture shop hosts an evening for customers and suppliers and is unsure whether the 6,000 € it cost counts as advertising or as entertainment. That is a classification question, so the right tool is the classification ruling. He describes the event, the invitations and the costs and proposes treating the expense as advertising, before filing the return.
Practical case
The deadline for challenging a refusal
On 7 May 2026 a taxpayer is served with an express refusal of a mandatory self-correction request. By what date must the refusal be challenged, counting days from the day after service?
Show the solution
An express refusal is challenged within sixty days of service. From 8 to 31 May, 24 days pass; June adds 30, for a total of 54. The remaining 6 days lead to 6 July 2026, a Monday.
Answer: By 6 July 2026
Practical case
A ruling request filed in summer
A company files a complete ordinary ruling request on 10 July 2026. It receives no request for documents and no reply. What is the last day available for the reply, after which tacit agreement arises? Count from the following day and allow for the suspensions provided.
Hint: Leave August out of the count and check which day of the week the deadline falls on.
Show the solution
From 11 to 31 July, 21 days pass. The period is suspended from 1 to 31 August. September adds 30 days, making 51, and October 31, making 82. The remaining 8 days lead to 8 November 2026, a Sunday, so the deadline moves to the next working day, Monday 9 November.
Answer: Monday 9 November 2026
Practical case
Mandatory or discretionary?
An assessment that was never challenged became final in February 2025. In April 2026 the taxpayer spots a calculation error and asks for self-correction. The office does not reply. Can the taxpayer challenge the silence?
Show the solution
A calculation error is a mandatory-correction defect, but more than a year has passed since the act became final. Cancellation remains possible only as discretionary self-correction, and for that kind only an express refusal can be appealed, not silence.
Answer: No, the silence cannot be challenged
