VAT on bad debts

Enter the unpaid amount including VAT, its rate and where the debt stands: the calculator says whether the tax already paid over to the Treasury can be recovered, what the taxable profit can bear, and what must be sent to the customer to be entitled to it.

Calculation assumptions

  • Stolen cheque: the tax doctrine allows the tax to be recovered as soon as the trader establishes that payment was made with a stolen cheque — that proof is enough to show the debt is irrecoverable. Enter such a case under "Definitively irrecoverable", not under "Debtor vanished": the exemption from correcting the invoice is reserved for a vanished debtor, and recovery remains subject to sending the customer a duplicate of the original invoice bearing the required wording. A bounced cheque, by contrast, opens the right only once every legal remedy has been exercised.
  • Unpaid debts only. Cancelled or terminated transactions, discounts, rebates and conditional early-payment discounts open the same article 272 but through another route — a replacement invoice or a credit note — which is not modelled here.
  • The qualification entered prevails: the calculator does not judge whether recovery proceedings have failed, whether the customer's situation is compromised, or whether a court ruling has been handed down. The burden of proving that the debt is bad lies with the creditor, and that proof follows from the established failure of recovery proceedings.
  • A single share is entered, read both as the portion of the price still unpaid and as the fraction whose recovery is compromised. A provision covering a narrower fraction than the unpaid share is not modelled.
  • The tax saving produced by the provision or the write-off is not computed: it depends on the regime and the rate applying to taxable profit.
  • Special regimes not modelled: factoring, licensed customs agents, tobacco suppliers, debt waivers granted under conciliation or safeguard proceedings, and the taxation of the indemnity paid by the credit insurer.
