French property company (SCI): corporate tax vs income tax
Under income tax, rents are taxed in the partners' hands as property income with no depreciation allowed, but the resale gain benefits from holding-period allowances; under corporate tax, depreciating the building relieves the rental result each year but reduces the net book value by the same amount, which increases the capital gain on disposal — the regime kept is the one whose total tax cost over the period is lower.

Calculation assumptions
- The calculation covers an unfurnished-letting, non-trading property company whose partners are individuals resident in France for tax purposes and hold all the shares. On the income-tax side, the micro-foncier regime is open to a partner only if they also directly own at least one property let unfurnished: the calculation assumes so. A partner who holds only company shares falls under the actual-expenses regime, and the tax on rents in the income-tax column may then be higher. Rents, expenses and the marginal tax rate are assumed constant over the whole holding period, and the sale is of the property itself, not of the company's shares.
- Under corporate tax, the tax cost computed here stops at company level: distributing the profit and the sale proceeds to the partners, which is taxed in their hands, is not modelled. The comparison is therefore structurally favourable to corporate tax for as long as the partners leave the funds inside the company.
- The conditions for the reduced rate of corporate tax (fully paid-up capital, at least 75 % held by individuals, turnover below the ceiling) are assumed to be met. The capital gain forms part of the disposal year's result: the reduced-rate bracket applies to that year's total profit, rental result included, and the excess is taxed at the standard rate.
- Depreciation is straight-line, on a single component, using the share and duration entered. Component-based depreciation (structure, roof, fittings), capitalised works during the holding period and capitalised acquisition costs are not modelled.
- On the income-tax side, the gain is computed on the acquisition price entered: the flat-rate allowances of the private capital gains regime (acquisition costs, works after more than five years of ownership) are not applied. Applying them would reduce the disposal tax in the income-tax column.
- The additional levy on large private property gains is not computed, nor are the special exemptions (main home, first disposal, particular holding periods).
- Under corporate tax, losses are carried forward without time limit and set off first against profitable years, then against the capital gain on disposal; the annual cap on the offset of carried-forward losses is not modelled, and any loss remaining after the disposal is lost in this calculation.
- The partners' income tax is estimated at the marginal rate entered, assumed constant: neither the bracket change that rents may trigger, nor the low-income rebate, nor the family quotient cap is modelled.
- Not quantified: the annual levy on rental income owed by companies subject to corporate tax, the registration duties on acquisition, the wealth tax on property, the accounting fees required by commercial bookkeeping, and the financing of the property.
