Italian registration tax on court judgments and payment orders: 3%, 1% or EUR 200

A judgment or enforceable payment order awarding a sum of money bears 3% registration tax; one declaring a property right, 1%; one with no financial content, voiding or terminating a contract, or approving an agreement, a flat EUR 200. The tax is never below EUR 200, and the 3% does not apply to the part of the award covering VAT-able supplies.

Calculation assumptions

  • The judgment is issued in 2026, so the tariff of Presidential Decree 131/1986 applies. The consolidated registration tax code (Legislative Decree 123/2025) applies from 1 January 2027 at the same rates.
  • The ruling contains a single taxable order. If it contains several of different kinds, each follows its own rule.
  • Not covered: rulings transferring property rights (taxed like the matching deed), separation and divorce, adverse possession, the flat tax on the VAT-able part, cases exempted by the Constitutional Court, and how the parties share the tax.
