German inheritance tax pension allowance — ErbStG s. 17 for spouses and children

The pension allowance comes on top of the personal allowance: EUR 256,000 for a surviving spouse or civil partner, and for children up to EUR 52,000 depending on age, until they turn 27. It is reduced by the capitalised value of survivors' pensions, such as widow's or orphan's pensions, that are exempt from inheritance tax.

Sources and assumptions

Calculation assumptions

  • The capitalised value of the exempt pensions is an input; it is determined under the Valuation Act (s. 14 BewG for spouses, s. 13 BewG for children).
  • The transfer arises on death; lifetime gifts carry no pension allowance.
  • Age is entered in completed years on the date of death; a child who has completed five years is 'more than 5'. A death falling on the birthday itself is placed in the higher age band.
  • Unlimited tax liability; the conditions for limited liability (s. 17(3)) are not checked.
