German business property relief — standard or optional relief under ErbStG ss. 13a and 13b

Relief does not apply to the business value as a whole, only to its qualifying part — the value less harmful administrative assets. Of that, 85 percent is exempt under standard relief, or 100 percent under the irrevocable optional relief, provided payroll is maintained for five or seven years respectively.

Sources and assumptions

Calculation assumptions

  • Fair market value, administrative assets, their net value and young administrative assets are inputs: working them out (Valuation Act, ErbStG s. 13b(4) to (10), cash test, pro-rata debts, group asset statement) is outside this calculator.
  • A single business is considered, whose fair market value equals the assets eligible for relief; the upfront discount for family-company clauses (s. 13a(9)) is not applied.
  • Above EUR 26 million of qualifying assets (including transfers from the same person over ten years) the s. 13a(1) relief falls away; the tapering relief (s. 13c) and the needs-based waiver (s. 28a) are flagged, not calculated.
  • The retention rules (s. 13a(6)) are assumed to be met; a breach would claw back relief pro rata, retroactively.
