There is NO statutory requirement in UK law for a premium overtime rate — it depends entirely on the employment contract or collective agreement (a common but non-mandatory practice is 'time and a half', a 50% premium). The one hard legal floor: the hourly rate across all hours worked (normal + overtime) must not fall below the National Living Wage (GBP 12.71/hour for workers 21+, from 1 April 2026). Under the National Minimum Wage Regulations 2015, any overtime PREMIUM is disregarded for this compliance check — only the base rate counts, even though the overtime hours themselves count toward total hours.

For 5 overtime hours at GBP 15/hour with a 50% agreed premium, plus 35 normal hours: total pay GBP 637.50 (premium included); NLW compliance is checked on the GBP 15 base rate, not the premium-inflated total — compliant.
